General Provisions

1. These Terms of Use apply to the use of the Netzhdk organization’s website.

2. Where reference is made below to data or information, this refers to digital content of various kinds, such as works (including images and other graphic representations, texts, music) and programmes; these are hereinafter generally referred to as data. 

Intellectual property

1. Insofar as individual works and digital content are subject to intellectual property rights (Immaterialgüterrechte), the relevant legal provisions apply, in particular copyright, design and trade mark law.

2. The holder of these rights is the Netzhdk association or the members of the association.

3. These rights may only be exercised within the scope of the usage rights provided for by law. If no legal authorisation exists, the relevant contractual permission must be obtained.

4. Where individual rights are subject to an open licence (for example, under an open Creative Commons licence), these usage rights may be exercised in accordance with the specified terms. 

Privacy policy

The Netzhdk organization is delighted that you are visiting our website and are interested in what we have to offer. As data protection is a matter of great importance to us, we would like to inform you about how we process and protect your personal data collected when you visit and use our website. In doing so, we comply with the provisions of Swiss data protection law.

1. Consent 

By using the Netzhdk website and our services, you accept this privacy policy and consent to the data processing and technical functions described herein, in particular the use of cookies and web analytics software.

3. What data is processed? 

We process various categories of data about you. The most important categories are as follows: 

Technical data or access data: 

When you visit our website, the following information about your visit is automatically recorded: 

– IP address of the requesting computer or mobile device 

– the website from which the visit originated (referrer) 

– date and time of the visit 

– content accessed 

– amount of data transferred 

– browser used 

– operating system used 

– language region 

This information is stored as log files on the ZHdK’s servers in Switzerland (Zurich and Winterthur) for the purposes of technical processes and for statistical analysis of website traffic. The analyses are used solely to improve the Netzhdk online offering and the underlying technology. The analyses are not personalised. 

Cookies 

The Netzhdk website uses only the following cookies: temporary session cookies and myfonts cookies. Cookies are files that are stored on your computer or mobile device when you visit or use our website. Cookies store certain settings via your browser as well as data relating to your interaction with the site. They also enhance the user-friendliness and security of our website. Temporary cookies are automatically deleted when you close your browser. Persistent cookies remain stored on your computer or mobile device. The latter are used to record visitor behaviour on the website and to collect statistics on website usage. 

To ensure the member login works technically, temporary session cookies must be set. These are deleted 30 minutes after you log out. 

To ensure the fonts used are displayed correctly across different browsers, myfonts is utilised. To fulfil this function, myfonts sets cookies. 

You can disable the storage of such cookies at any time via the relevant settings in your web browser, thereby preventing the permanent use of cookies. Please note that this may result in certain functions of our website no longer working properly (subscriptions to newsletters, event registration, membership and member login). Furthermore, you can delete cookies stored on your device at any time via your browser or other software programmes. 

The personal data will then be deleted. However, if there are concrete indications of an unlawful act or an attack on the network infrastructure, the deletion of the data may be postponed until the matter has been clarified. 

Registration details 

Newsletter 

We are happy to keep you informed about Netzhdk via various newsletters. To register and receive these, we require the following personal details from you: 

– Email address 

– First name and surname 

– Address (particularly for postal deliveries) 

This personal data will be used exclusively for sending news, event information and offers from Netzhdk. By voluntarily entering and submitting your personal data, you consent to its processing, storage and use for the aforementioned purpose. We use the data exclusively for sending newsletters or postal mailings and do not pass it on to third parties. You can unsubscribe from the relevant newsletters at any time, in which case your contact details will be deleted. You will find the relevant unsubscribe link at the end of each newsletter. 

Registration form for membership or event participation 

By entering your personal details in our registration forms, you agree that we may process your personal data for the purposes of the relevant membership or course or conference administration and the sending of event notifications in this context. Personal data will only be used for as long as it is required for the aforementioned purpose. 

Communication data 

If you contact us via email or the contact form, you consent to us storing your email address, IP address and any other personal data you provide for the purpose of processing your enquiry and for any follow-up questions. Personal data will only be used and forwarded to the relevant points of contact at Netzhdk for as long as it is required for the aforementioned purpose. It will not be passed on to third parties without your express consent. 

Master data 

We refer to master data as the basic information we require to manage the various memberships (such as name, contact details and, where applicable, additional information such as your membership status or any preferences you may have). 

Behavioural and preference data 

We may assess certain personal characteristics of yours automatically or manually based on your data (‘profile’) when we wish to determine preferences, carry out statistical analyses or develop operational plans. For the same purposes, we may also create profiles, i.e. we may combine behavioural and preference data, as well as master data and technical data associated with you, in order to better serve you as an individual with your various interests and other characteristics. 

4. Purposes of data processing 

We process personal data solely in the context of our legitimate interest in providing you with information and offers – such as membership, newsletters or participation in events. 

5. Legal basis 

In principle, the processing of your data is always based on your consent, which you may withdraw at any time. 

6. Obtaining data from third parties 

In general, we obtain all the data we process about you directly from you, and therefore on the basis of your consent. In exceptional cases, we reserve the right to obtain data about you from public sources (the internet, the media) or from the post office (such as your current postal address). 

7. Disclosure of Data 

In connection with the operation of our website, our services and activities, we do not, as a rule, disclose any data about you to third parties. 

In exceptional cases, the following categories of third-party data processors may have access to your data: 

– Service providers: We generally only work with service providers in Switzerland who process data about you on our behalf or under joint responsibility with us, or who receive data about you from us under their own responsibility (e.g. IT providers, external IT service providers, delivery companies, payment service providers [such as eventfrog] or address verification services/postal services). 

These agents are prohibited from processing personal data for their own purposes or from passing such data on to third parties. 

– Media: When we collaborate with media organizations and provide them with material (e.g. photos from public events), you may be affected (in the case of photos from public events organised by us). The same applies to the publication of content (e.g. photos, interviews, quotes, etc.) on our website or in other publications by us. 

8. No disclosure of data abroad 

As explained in section 6, we disclose data to third parties for the purpose of providing certain services. These third parties and their servers are generally located in Switzerland. In exceptional cases, however, your data may be processed within Europe (e.g. publication of photos by the media) or, where necessary, in any country worldwide (for technical reasons, this applies to your internet communications when using our website, particularly if you are abroad). 

Even if you are in Switzerland and access our services (which are hosted on servers in Switzerland) via the internet, your data may be transferred abroad, as internet connections are often routed via third countries for technical reasons. 

9. Storage of personal data 

We store personal data for as long as it is: 

– necessary for the purposes for which it was collected or where we have a legitimate interest, 

– required to fulfil our legal or contractual obligations 

– or until you withdraw your consent. 

After that, the personal data will be deleted. Where there are concrete indications of an unlawful act or an attack on the network infrastructure, the deletion of the data may be postponed until the matter has been clarified. 

Session cookies are deleted 30 minutes after logging out; myfont cookies are deleted after 30 days; log files are deleted after 15 days. 

10. Online Tracking 

On our website, we use various techniques that enable us and third parties we engage to recognise you when you use the site and, in some cases, to track your activity across multiple visits. This section provides further information on this. 

Essentially, the aim is to enable us to distinguish your visits (via your system) from those of other users, so that we can ensure the website functions properly and carry out analyses and personalisation. We do not intend to deduce your identity from this, even though we are technically able to do so, provided that we or third parties engaged by us can identify you by combining this data with registration details. Even without registration data, however, the techniques used are designed in such a way that you are recognised as an individual visitor each time you visit a page, for example by our server (or the servers of third parties) assigning a specific identification number to you or your browser (a so-called ‘cookie’, see section 3). We use myfonts, which is integrated via the provider. Data processing by myfonts is governed by their privacy policy. 

11. By using this website, you consent to the processing of data collected about you by web analytics software in the manner described below and for the stated purpose. 

The following information may be collected: 

– IP address 

– The navigation path a visitor takes on the website 

– Time spent on the website or subpage 

– Subpage from which the website is exited 

– Language region from which access is made 

– Device (type, version, colour depth, resolution, width and height of the browser window) 

– Returning or new website visitor. 

12. We occasionally use content or services provided by third parties on our website in order to integrate their content and services, such as videos (YouTube or Vimeo) (hereinafter referred to as ‘content’). As a result, the third-party providers of this content will be able to see the user’s IP address. The IP address is therefore necessary for the transmission and display of this content. The information may also be stored in cookies on the user’s device and may include, amongst other things, technical information about the browser and operating system, referring websites, time of visit, language region and further details regarding the use of our online service. Furthermore, third-party providers may process such information further, particularly if the visitor is simultaneously logged into the respective third-party provider’s platform. 

Netzhdk has no influence over the manner in which data is transmitted and has a legitimate interest in incorporating this external content. The use of such third-party services is governed by their terms of use. 

The Netzhdk website uses external fonts to ensure a consistent and attractive presentation. When you visit the website, the browser you are using must connect to the provider’s servers in accordance with the licence agreement. As a result, myfonts.net becomes aware of your IP address, which accessed our website, and may store it. Netzhdk has no influence over the manner in which this data is transmitted. 

Various links on the Netzhdk website lead to third-party websites. You use these linked websites at your own risk and in accordance with their privacy policies. Netzhdk accepts no responsibility for the accuracy, completeness or legality of the content and offers contained therein. 

13. Data Security 

We take appropriate security measures to safeguard the confidentiality, integrity and availability of your personal data, to protect it against unauthorised or unlawful processing, and to mitigate the risks of loss, accidental alteration, unauthorised disclosure or unauthorised access. 

To protect the security of your data when using our website, we use the most up-to-date encryption method (currently via HTTPS with an SSL certificate). 

However, the transmission of information via the internet and other electronic means is always subject to certain security risks, and Netzhdk cannot guarantee the security of information transmitted in this way. 

Netzhdk employees and the service providers commissioned by us are bound by confidentiality and compliance with data protection regulations in accordance with their employment contracts (which include a duty of official secrecy) or service agreements.

14. Your rights 

Visitors to our website may at any time request information regarding the processing of their personal data and its use. You generally have the right to rectification, data portability, restriction of processing or erasure of your data. If consent has been given for the use of personal data, this may be withdrawn at any time. 

For information regarding personal data processed by us and to exercise the above-mentioned rights, please contact the Netzhdk office (see section 2). 

15. Changes to this privacy policy 

This privacy policy may be amended at any time due to legal requirements, technical developments or changes to the website. 
 

Warranties

1. Netzhdk and its affiliates have taken all reasonable care to ensure the accuracy, completeness and lawfulness of the published data.

2. No warranty can be given as to the accuracy, completeness and lawfulness of the data and links published on the website.

3. Netzhdk shall only be liable for the content and compliance with the relevant provisions to the extent that it is aware of unlawful content and can be held responsible for it under applicable law.

4. Netzhdk reserves the right to amend, delete or temporarily withhold publication of the website’s content, in whole or in part, at any time without notice.

5. Liability claims against Netzhdk for material or immaterial damage arising from unauthorised access to or use of the published data, misuse of IT resources or technical faults are excluded.

6. Netzhdk has not reviewed external websites that are not hosted on its servers or within its sphere of influence, or that may be linked to this website, and accepts no responsibility for the content or services offered on such sites. 

Further provisions

Swiss law shall apply, in particular the provisions of the special laws on intellectual property and personality rights, as well as the relevant criminal provisions.
